Terms of Service

1. Acceptance of Terms
By accessing our website at albertoserratophotography.com or engaging our photography and videography services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
2. Services Provided
Alberto Serrato Photography offers professional photography and videography services, including but not limited to quinceañera photography, wedding photography and videography, portrait sessions, and event coverage in the Dallas–Fort Worth area.
All service agreements, packages, pricing, and deliverables are subject to a separate written contract or booking agreement signed by both parties prior to the event.
3. Booking and Deposits
- A non-refundable retainer/deposit is required to secure your event date. This deposit is applied toward your total balance.
- Dates are not held or reserved until a deposit is received and a signed contract is in place.
- Full payment is due on or before the date of the event unless otherwise specified in writing.
4. Cancellations and Rescheduling
- Cancellations must be submitted in writing via email.
- The non-refundable deposit is forfeited upon cancellation.
- Rescheduling requests are subject to availability and must be made at least 30 days in advance.
- In the unlikely event that Alberto Serrato Photography must cancel due to an emergency, we will make every effort to find a qualified replacement photographer and/or issue a full refund.
5. Deliverables and Timeline
- Final edited images and/or videos will be delivered within the timeframe specified in your individual service agreement.
- We reserve the right to use our professional judgment in selecting, editing, and curating final images.
- Rush editing services may be available for an additional fee.
6. Copyright and Usage Rights
All photographs and video content produced by Alberto Serrato Photography are protected by U.S. copyright law. Alberto Serrato Photography retains full copyright ownership of all images and videos.
- Clients are granted a personal, non-exclusive, non-transferable license to use the delivered images and videos for personal use only.
- Commercial use, resale, or distribution of images/videos without written permission is strictly prohibited.
- We reserve the right to use client images for portfolio, website, social media, and marketing purposes, unless the client requests otherwise in writing prior to the event.
7. Client Responsibilities
- Clients are responsible for providing accurate event details, timelines, and venue access information.
- Clients must ensure that all individuals being photographed have consented to being filmed/photographed.
- We are not responsible for missed shots due to late starts, venue restrictions, or uncooperative guests.
8. Limitation of Liability
Alberto Serrato Photography shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. In the event of equipment failure, accident, or other unforeseen circumstances that prevent us from delivering agreed services, our maximum liability shall be limited to a refund of amounts paid.
9. Consent to Receive Communications
By providing your phone number and submitting a contact form or booking inquiry, you consent to receive SMS/text messages from Alberto Serrato Photography related to your booking and services. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance.
We do not use purchased, rented, or affiliate contact lists. All communications are sent only to individuals who have opted in directly.
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the appropriate courts of Dallas County, Texas.
11. Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted to our website with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
